When you visit third-party websites, you should read their privacy policies and any other policies applicable to the collection and processing of personal data.<\/p><h2>Other data we collect<\/h2><p><strong>Continuous in real-time or near real-time:<\/strong> data from meter and other devices connected to Evolut-ion devices (solar panels, battery, EV chargers and others). This data includes (but is not limited to): power, energy, voltage, current, setpoints, device status, device operating modes and device faults\/error notifications, is collected at 1 second intervals and stored locally on the Evolut-ion device. The same data, but aggregated to 1-minute and 15-minute intervals, are also stored in the Evolut-ion cloud (based in the EU) for purposes of calculation, analysis, forecasting, reporting and display to end user (via mobile app or web page).<\/p><p><strong>Once or occasionally (when user changes this):<\/strong> user data such as (but not limited to) data entered in the user account registration process, such as (but not limited to) email, physical location (street address or GPS coordinates) of the Evolut-ion device, name, connected devices, ID of the Evolut-ion device. This data is stored locally on the Evolut-ion device and in the Evolut-ion Cloud.<\/p><p>Evolut-ion does not disclose this data to third parties unless it is necessary for the performance of services (for example, but not limited to physical location to obtain weather forecasts), or it is regulated (for example, but not limited to data requested by the grid operator as required by relevant regulations) or under the law.<\/p><h2>Protection of personal data<\/h2><p>We will take all necessary measures to ensure the secure processing of your data in accordance with our privacy policy. You are also responsible for protecting personal data; especially if you are a user of the web application and\/or the controller. Please ensure the security of your username and password and use appropriate software to protect your devices that you use to access our websites or the controller.<\/p><p>We use cloud technology to store data from the web application and controller. This is equipped with a security mechanism that ensures a high level of data protection. Through advanced encryption of communications, data is secure in case of misuse, as well as in case of misuse by an unauthorized person. The controller and the Web application are secured with symmetric and asymmetric encryption and are thus covered by high security standards.<\/p><p>This website is secured with an SSL certificate; personal data is protected during information transfer.<\/p><p>When you purchase our controller, you become the owner of the controller. This makes you fully responsible for protecting your personal data. Evolut-ion does not have access to controller data unless you give us permission for support or configuration assistance. If you give us permission to access the controller, we will act in accordance with this privacy policy.<\/p><p>When you connect to the web application, you must consent to agree to our privacy policy. In this case, we will have access to the controller you use, including certain personal information such as your username. If you do not give consent, we will not be able to provide you with certain services.<\/p><p>We use all available means to protect your personal information, but we cannot guarantee absolute security. The security of your personal information is very important to us, but you should be aware that no method of transmission over the Internet or method of electronic storage 100% is secure.<\/p><h2>Your rights<\/h2><p>With respect to the processing of personal data, you have the following rights:<\/p><h3>(a) Right to access personal data<\/h3><p>As an individual, you have the right to request information about whether we process personal data about you. If we process your personal data, you have the right to access information about what personal data we process and certain information related to your personal data.<\/p><h3>(b) Right to withdraw consent<\/h3><p>If you, as an individual, have consented to the processing of your personal data, you may withdraw this consent at any time, without affecting the legality of data processing carried out on the basis of consent until its withdrawal.<\/p><p>Withdrawing consent to process personal data has no negative consequences or penalties for the individual. The data must be in a commonly used and machine-readable format.<\/p><p>As an individual, when exercising the above right to data portability, you have the right to have personal data transferred directly from one processor to another, when technically feasible.<\/p><h3>g) Right to object to data processing<\/h3><p>Where processing is carried out for legitimate interest that we are pursuing, you may object to such processing at any time. Evolut-ion will no longer process your personal data unless otherwise required by applicable law.<\/p><p>Where personal data is processed for marketing purposes, you have the right to object at any time to the processing of your data for these marketing purposes, including profiling, insofar as it relates to direct marketing; once you have objected to processing for direct marketing purposes, the data will no longer be processed for these purposes.<\/p><p>Where data are processed for purposes of scientific or historical research or statistical purposes, you have the right to object to the processing of your data for reasons relating to your particular circumstances, unless processing is necessary for the performance of a task carried out in the public interest.<\/p><h3>(h) Right to file a complaint with the supervisory authority<\/h3><p>Without resorting to any other legal remedy (administrative or otherwise), you have the right, as an individual, to lodge a complaint with a supervisory authority, in particular in the country in which you have your habitual residence, place of work or where the alleged breach has taken place (in Belgium: the Personal Data Authority), if you believe that the processing of personal data about you is in breach of personal data protection provisions.<\/p><p>Without resorting to any other (administrative or judicial) remedies, you are entitled as an individual to an effective remedy, namely against the binding decision of the supervisory authority with respect to you, as well as in the event that the supervisory authority does not deal with your complaint or does not inform you of the status of the case or of the decision on the appeal within three months. The courts of the Member State in which the supervisory authority is located are competent for proceedings against the supervisory authority.<\/p><p>For the purpose of reliable identification when exercising rights relating to personal data, the controller may request additional data from the individual and may refuse to act only if it demonstrates that it cannot reliably identify the individual.<\/p><p>The controller must respond to the individual's request exercising his\/her rights with respect to personal data without undue delay and no later than one month after receiving the request.<\/p><h2>Privacy policy changes<\/h2><p>This privacy policy shall become effective on March 23, 2025 and shall remain in force, except in case of additions or changes to the privacy policy that may occur in the future.
